VOSH Complaint Handling Process

VOSH evaluates each complaint to determine how it can be best handled - - an off-site investigation or an on-site inspection. Workers who would like an on-site inspection must submit a written request. Workers who complain have the right to have their names withheld from their employers, and VOSH will not reveal this information. At least one of the following eight criteria must be met for VOSH to conduct an on-site inspection:

  1. The complaint was reduced to writing, is signed by a current employee or employee representative, and states the reason for the inspection request with reasonable particularity.  In addition, there are reasonable grounds to believe that a violation of a safety or health standard has occurred.

  2. Imminent danger hazard;

  3. Serious hazard, which in the discretion of the Commissioner or his authorized representative, requires an onsite inspection;

  4. Permanently disabling injury or illness related to a hazard potentially still in existence;

  5. The establishment has a significant history of non-compliance with VOSH laws and standards;

  6. The complaint identifies an establishment or an alleged hazard covered by a local or national emphasis inspection program;

  7. A request from a VOSH/OSHA discrimination investigator to conduct an inspection in response to a complaint initially filed with the investigator;

  8. The employer fails to provide an adequate response to a VOSH investigation contact, or the complainant provides evidence that the employers response is false, incorrect, incomplete or does not adequately address the hazard.
